work to national standards and legal obligations, recognising the sensitivity of
both workplace and sporting environments.
Workplace and sport investigations conducted by WorkSport apply the civil standard of
proof, known as the balance of probabilities. This means that findings are made based on
whether it is more likely than not that the alleged conduct occurred, having regard to
all available evidence.
In applying this standard, WorkSport is guided by the principles established in
Briginshaw v Briginshaw. These principles recognise that the seriousness of an
allegation and the potential consequences for the individual involved require a careful
and rigorous assessment of the evidence. More serious allegations demand clearer, more
cogent evidence before a finding can be made.
This approach ensures investigations are fair, balanced, and defensible, and that
findings are reached through a reasoned evaluation of the evidence rather than
speculation or assumption.
